Given the declaration of a state of health emergency, the Court of Appeal must, save for the exception mentioned below, reschedule all of the hearings that were to be held between March 17 and April 3, 2020, inclusively, whether the hearing was to take place before a panel of judges or a judge sitting alone. The Court office will contact counsel or unrepresented parties whose files or applications/motions were to be heard during that period and will inform them of a new hearing date. In the event of an emergency, parties are asked to contact the Court office in writing (i.e., by letter sent by fax or email - see below for the contact information of the offices of the Court in Montreal and Quebec City) and provide a detailed explanation of the reasons for the emergency. If the Court considers the situation urgent, the Court office will contact counsel or the parties in order to determine the date and conditions for the required hearings.
Exceptionally, applications/motions scheduled on the roll of the judge sitting alone in Montreal and Quebec City on March 17, 18, 19 and 20, 2020 will remain on the roll and be heard as scheduled (unless counsel or unrepresented parties request a postponement). These hearings, however, will be held by conference call. The Court office will contact counsel or unrepresented parties in order to make the necessary arrangements for these conference calls. Moreover, unless a situation is urgent, no new applications/motions will be added to the roll for the current week.
