Preferences prescribed by Law

Article 80 of the Regulation of the Court of Appeal of Quebec in Civil Matters stipulates:

              80.     Preferences Prescribed by Law. The clerk publishes the preferences prescribed by law on the Court’s website.

The following is the list of appeals which, by law, shall be heard by preference:

In Civil Matters

  • Habeas Corpus applications (s. 82 and 383 C.C.P.);
  • Applications regarding personal integrity (consent to care, confinement in a health or social services institution, psychiatric assessment) (s. 82 and 383 C.C.P.);
  • Family matters pertaining to support obligations, child custody or related provisional measures (s. 368 and 374 C.C.P.);
  • Appeal of a judgment rendered in the course of a proceeding (s. 368 and 374 C.C.P.);
  • Authorization to institute a class action (s. 578 C.C.P.);
  • Judicial demands for the forced return of a child (s. 19 of An Act Respecting the Civil Aspects of International and Interprovincial Child Abduction, CQLR, c. A-23.01);
  • Final judgments quashing a by-law or setting aside a procès-verbal, roll, resolution or other order of a municipal council (s. 352, 397 and 408 Cities and Towns Act, CQLR, c. C-19);
  • Contestations of municipal elections (s. 295 and 296 of An Act Respecting Elections and Referendums in Municipalities, CQLR, c. E-2.2);
  • Orders enjoining a judge of the Court of Quebec to proceed with and complete a judicial recount (s. 397 and 398 of the Election Act, CQLR, c. E-3.3);
  • Contestation of elections (s. 458, 475 and 476 of the Election Act, CQLR, c. E-3.3);
  • Contestation of the right to expropriate (s. 44 and 44.2 of the Expropriation Act, CQLR, c. E-24);
  • Orders to wind up a company (s. 32, para. 1 of the Winding-up Act, CQLR, c. L-4);
  • Appeals in youth protection matters (s. 107, 115 and 129 of the Youth Protection Act, CQLR, c. P-34.1).
  • Appeal regarding disclosure of information in relation to journalistic sources (s. 39.1 Canada Evidence Act, R.S.C. 1985, c. C-5)

In Criminal and Penal Matters

  • Appeals against dispositions made by a court or a Review Board, or placement decisions made by a Review Board respecting a person with a mental disorder (s. 672.72(3) Criminal Code, R.S.C. 1985, c. C-46);
  • Habeas corpus applications (s. 784(6) Criminal Code, R.S.C. 1985, c. C-46);
  • Appeals in extradition matters (s. 51 and 57(5) of the Extradition Act, S.C., 1999, c. 18);
  • Evidentiary objections based on article 283 C.C.P. or section 9 of the Charter of Human Rights and Freedoms (s. 292 of the Code of Penal Procedure, CQLR, c. C-25.1);
  • Appeal from a disclosure order rendered pursuant to sections 37 (4.1) to (6) of the Canada Evidence Act (s. 37.1 Canada Evidence Act, R.S.C. 1985, c. C-5).
  • Appeal regarding disclosure of information in relation to journalistic sources (s. 39.1 Canada Evidence Act, R.S.C. 1985, c. C-5)
