A motion may be presented to the Court, either before a judge or before the Clerk. When the expression "the Court" is used in law, the motion must necessarily be presented before a panel of 3 judges. If the expression "the Court or a judge" is used in law, the motion may be presented before a judge sitting alone. A non-exhaustive list is given to you for certain situations. In the case of shared competency the more efficient option is chosen by the Court.
