Court of Appeal of Quebec

Aide-memoire

NOTE

This section is designed for those who are involved in the appellate process for the first time. It does not dispense the reading of the relevant sections of the law, such as:

Even though no one is required to be represented by attorney before the courts, it is strongly recommended that an attorney be consulted.

Aide-memoire in civil matters

Note: This guide, created for those who are involved in the appellate process for the first time, does not bind the Court or its judges, and it does not exempt those who use it from reading the relevant provisions of the Code of Civil Procedure (C.C.P.), the Regulation of the Court of Appeal of Quebec in Civil Matters (R.C.A.Q.Civ.M.) or any other relevant legislation. Although natural persons (as opposed to companies, which must be represented by a lawyer) can represent themselves, it is strongly recommended that a lawyer be consulted.

This aide-memoire is divided into four parts:

  1. How to file an appeal in civil matters
  2. Next steps following the opening of a court file in civil matters
  3. Physical preparation of briefs and memoranda
  4. Applications in the course of a Proceeding in civil matters
