REMINDER: Pilot project concerning the delay for presentation – Applications made to an appellate judge sitting alone under the Code of civil procedure

In order to improve the efficiency of the hearings held before an appellate judge sitting alone, a new method of operation shall be established starting December 1st, 2018. For an application presented to an appellate judge as of that date, the applicant is strongly encouraged to file the motion at least five (5) days before the date of its presentation (instead of the two (2) days’ delay specified in article 377 of the Code of civil procedure).

When a motion is filed in accordance with this new timeframe, the responding party may, if it so wishes, submit to the court’s office and notify to the other parties, at least two (2) days before the date the application is to be presented, a document not exceeding two (2) pages setting out its position and its observations in the form of a plan of argument. If submitted, such document must comply with articles 21 to 24 of the Civil practice regulation (Court of Appeal) (CQLR, c. C-25.01, r. 10).
