From November 27 to 30, the hearing of the "Reference to the Court of Appeal of Quebec pertaining to the constitutional validity of the provisions of article 35 of the Code of Civil Procedure which set at less than $85,000 the exclusive monetary jurisdiction of the Court of Québec and to the appelate jurisdiction assigned to the Court of Qubec" will take place. By Order in Council of the Government of Quebec bearing number 880-2017, the following constitutional questions are referred to the Court of Appeal for hearing and consideration:
This Order in Council was filed with the Office of the Court of Appeal for the District of Montreal under docket No. 500-09-027083-179 on October 5, 2017. The hearing will take place over four days before a seven-judge panel composed of Chief Justice Duval Hesler as well as justices Bich, Kasirer, Levesque, Vauclair, Mainville and Hogue.
